Terms & Conditions

Who the Agreement Is Between

The agreement is between:

  • The Service Provider (Rappid Response Proprietary Limited, South Africa) and its affiliates; and

  • You, the end-user of the Application and Services.

By downloading, registering for, or using the Application, you agree to be legally bound by the Terms.

What the Service Provider Provides

The Service Provider operates a technology platform that:

  • Connects users to the nearest vetted private (or, where necessary, public) security or medical responders

  • Uses geolocation to dispatch assistance after a Panic Activation

  • Operates in defined Coverage Areas (currently South Africa, Kenya, and the United Kingdom)

The Service Provider:

  • Facilitates access to independent third-party Responders

  • Does not directly provide armed response or emergency medical services

  • Does not guarantee response times or availability

Nature of the Service

  • Services are activated via the mobile Application, panic button remote, or emergency phone line.

  • Responders are independent contractors, not employees or agents of the Service Provider.

  • Availability depends on:

    • Geographic coverage

    • Network signal

    • Device functionality

    • Responder availability

Out-of-coverage areas may result in delayed or no response.

Subscription & Fair Usage

  • Services begin upon sign-up and continue indefinitely unless cancelled.

  • Users may cancel via the Application (effective within 35 days).

  • Each subscription includes.

  • A surcharge may apply if the Response Limit is exceeded.

  • The Service Provider may reject activations exceeding the fair usage limit.

User Responsibilities

You are responsible for:

  • Providing accurate and updated personal information

  • Maintaining device functionality, battery, signal, and data access

  • Safeguarding login credentials and OTP verification

  • Ensuring panic button devices are properly linked

  • Complying with applicable laws

  • Misuse, unlawful activity, or breaches may result in immediate termination.

Coverage Limitations

Services are limited to defined Coverage Areas and may change.

  • In Out-of-Coverage Areas:

  • Response is not guaranteed

  • No response time estimates are provided

  • Public or alternative responders may be used

  • You indemnify the Service Provider against claims arising from response delays or non-response.

Panic Button Remote

  • Manufactured by independent third parties.

  • The Service Provider is not responsible for:

  • Device malfunction

  • Warranty claims

  • Damage, battery failure, or courier costs

  • Only one panic button may be linked per profile.

  • Unlinked devices will not trigger a response.

Emergency Phone Line

  • Only registered numbers will be recognized.

  • The Service Provider is not liable for:

  • Signal loss

  • Lack of airtime/data

  • Inaccurate or missing location data

  • SMS failures

  • You must update your mobile number if it changes.

Intellectual Property

  • The Service Provider retains ownership of all intellectual property in the Application and Services.

  • Users receive a limited, revocable, non-transferable license for personal use only.

  • Reverse engineering, copying, or misuse of content is prohibited.

Personal Information & Data Protection

The Service Provider processes personal information in accordance with applicable data protection legislation, including:

  • South Africa’s Protection of Personal Information Act (POPIA)

  • Kenya’s Data Protection Act

  • UK Data Protection Act

  • Other applicable data protection laws

Key points:

  • Location data is used for emergency dispatch purposes.

  • Information may be transferred internationally where necessary.

  • De-identified data may be used for analytics and service improvement.

  • You must obtain consent when providing third-party personal information.

System Availability

The Service Provider does not guarantee uninterrupted access to:

  • The Application

  • Network connectivity

  • Third-party integrations

  • Responder acceptance

Services are provided “as is” and “as available.”

Warranties & Disclaimers

You warrant that:

  • You have legal capacity to enter into the agreement.

  • You are not prohibited from receiving the Services.

  • All information you provide is accurate.

The Service Provider disclaims all implied warranties including:

  • Merchantability

  • Fitness for purpose

  • Accuracy

  • Non-infringement

  • Continuous availability

Limitation of Liability

  • Use of the Services is at your own risk.

  • The Service Provider is not liable for:

    • Acts or omissions of Responders

    • Device failure

    • Signal/data issues

    • Service interruptions

    • Indirect or consequential damages

  • Maximum cumulative liability is capped at GBP 500.

Indemnity

You indemnify the Service Provider against claims arising from:

  • Delays or rejected responses

  • Acting on instructions received via your account

  • Inaccurate personal information

  • Exceeding fair usage limits

  • Third-party misuse of your account

Dispute Resolution

  • Disputes must first be resolved through negotiation.

  • If unresolved, disputes proceed to arbitration under AFSA rules.

  • Arbitration venue: Johannesburg.

  • Proceedings conducted in English.

  • Urgent court relief remains available.

Governing Law

The Terms are governed by the substantive laws of South Africa, regardless of where the Services are provided.

Changes to Terms

  • The Service Provider may update the Terms at any time.

  • Continued use of the Application constitutes acceptance of revised Terms.

  • Users are responsible for reviewing updates.
